"ICE agents are empowered, without a warrant, 'to interrogate any alien or person believed to be an alien as to his right to be or to remain in the United States' and to arrest any 'alien...in the United States', if they have 'reason to believe' that the alien 'is in the United States in violation of any such law or regulation'. They may also obtain warrants to arrest people whom they believe are subject to deportation, though this formal procedure is rarely used. Over the years, many procedures of deportation have been standardized. Most persons arrested for deportation are given a charging document (a 'Notice to Appear' [a.k.a. 'Notice to Disappear']) that lists their alleged violations of law. They then [sometimes] appear before immigration judges (employed by the DoJ) in hearings that must comply with some consitutional requirements of 'fundamental fairness' and 'due process'. The government, in virtually all cases, has the technical burden of proving at least that the arrestee is not a citizen (referred to as the burden of proving 'alienage'). For the 'undocumented', that often is the end of the matter unless they fear persecution or torture. In cases involving otherwise legal residents who face deportation due to post-entry conduct, the government must also prove by clear and convincing evidence that the preson is 'deportable'.
