"Edward J. Erler points out that the author of the clause [of the 14th amendment], senator Jacob Howard, emphatically stated that those ‷subject to the jurisdiction‴ of the United States [of America] ‷will not, of course, include persons born in the United States [of America] who are foreigners‴ or ‷aliens‴. IOW, the 14th Amendment was never intended to grant automatic citizenship of USA-born children of foreigners, and the supreme court erred in 1898 when it ruled otherwise. (The court has never ruled that USA-born children of illegal aliens are citizens, although that too is current federal policy.) Senator Howard's reading, enorsed by senator Lyman Trumbull, chairman of the senate Judiciary committee, and by the supreme court in the Slaughter House cases, is the only reading of the amendment that is consistent with the equality principle, according to which, as we showed above, no one can justly become a citizen of a nation without its consent. The [polity's] first naturalization law of 1790 reflected the Founders' concern for republican character. It required would-be citizens to apply ‷to any common law court of record in any of the states wherein he shall have resided,...and mak[e] proof to the satisfaction of such court that he is a person of good character‴. (This could ordinarily be done by having a citizen sponsor testify on one's behalf.) They also had to take ‷the oath or affirmation prescribed by law to support the constitution of the United States [of America]‴. Most states had similar requirements for state citizenship. Remnants of this concern for the character of new-comers survive today. According to a 1989 government brochure, federal law generally forbids entry to any person who is a ‷beggar‴, has ‷committed a serious crime‴, is ‷coming for immoral sexual acts‴, or is otherwise morally objectionable. Except that computer people use 2 as a base raised to multiples of powers of 10, instead of 10 raised to multiples of powers of 3 because powers of 2 are handier for them, but they also want to stay somewhat close to the values of 10 most folks are used to.
